Welcome to LuvruFashion. Throughout the site, the terms “we”, “us” and “our” refer to LuvruFashion. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

LuvruFashion is a business registered in Germany and is powered by Shopify Inc. By purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

SECTION 1 - GENERAL CONDITIONS & LEGAL CAPACITY

By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence. Our store is located in Germany; therefore, all contracts are concluded in accordance with the laws of the Federal Republic of Germany and applicable EU consumer protection regulations.

SECTION 2 - PRODUCTS AND ACCURACY

We make every effort to display the colors and images of our products accurately. However, we cannot guarantee that your computer monitor's display of any color will be accurate.

  • Direct Fulfillment: You acknowledge that LuvruFashion utilizes an international fulfillment model. Products are dispatched from our international logistics hubs (overseas).

  • Specifications: We reserve the right to limit the sales of our products to any person or geographic region.

SECTION 3 - FORMATION OF CONTRACT (Orders)

In accordance with German law (§ 145 BGB), the presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

  1. By clicking the "Complete Order" (or similar) button, you place a binding order for the goods in the shopping cart.

  2. A binding contract is formed only when we accept your order by sending an order confirmation email or by delivering the goods.

  3. We reserve the right to refuse any order you place with us.

SECTION 4 - PRICES AND CUSTOMS

  • Taxes: All prices include applicable VAT where required by the destination country under the EU OSS (One-Stop Shop) rules.

  • Import Charges: Since goods are shipped from outside the EU (Direct Fulfillment), the customer is the "Importer of Record." While we strive to minimize additional fees, any customs duties or import taxes levied by your local authorities are the sole responsibility of the customer.

SECTION 5 - RIGHT OF WITHDRAWAL (Widerrufsrecht)

As a consumer in the EU, you have a statutory 14-day right of withdrawal.

  • You are responsible for the direct costs of returning the goods internationally.

SECTION 6 - SHIPPING AND DELIVERY

Delivery times (typically 7–15 business days) are estimates and not guaranteed.

  • Transfer of Risk: If you are a consumer in the EU, the risk of loss or damage to the goods passes to you only when you (or a third party designated by you) have received the goods.

SECTION 7 - LIMITATION OF LIABILITY

For customers in Germany/EU, our liability is governed by statutory law, with the following modifications:

  1. We are liable without limitation for damages caused by intent or gross negligence.

  2. In cases of slight negligence, we are only liable for the breach of an essential contractual obligation (cardinal obligation). In such cases, liability is limited to the typically foreseeable damage.

All content on this site is the property of LuvruFashion. You may not reproduce, duplicate, copy, or sell any portion of the Service without express written permission from us.

SECTION 9 - PRIVACY

SECTION 10 - GOVERNING LAW AND JURISDICTION

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.

  • For consumers, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.

  • The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

SECTION 11 - ONLINE DISPUTE RESOLUTION

The European Commission provides a platform for Online Dispute Resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
